Section 1: Definitions
“Information” is any data, personal or otherwise, that is:

Transferred from you to All Around Music, regardless of its country of origin; and

“Personal Information” pertains to a specific individual, whether the individual is you or not, and can be linked to that individual.
“Sensitive Personal Information” means Personal Information that reveals race, ethnic origin, sexual orientation, political opinions, religious or philosophical beliefs, trade union membership, or concerns an individual’s health.
The “Website” includes all pages and content found or accessed under the All Around Music domain name: www.allaroundmusic.us.
The “Web Portal” includes all password-protected areas of www.allaroundmusic.us and all content downloaded, viewed, or accessed there.
“Software” includes all programs, routines, and symbolic languages downloaded or accessed through the Website or Web Portal or otherwise provided by All Around Music that control any functionality or direct any operations on a computer.
Collectively, the Website, Web Portal, and Software are referred to as the “Services.”
“User” means anyone accessing or using the Services provided by All Around Music, whether they are registered Users, guests, or internet Users, even if they did not directly access the Service used. It also includes persons using the Service even if they are accessing the Service through another person’s account.

Section 2: What Information All Around Music Collects and Why
Any time a User accesses the Website or Web Portal, they receive a “cookie” from us. We use cookies (small pieces of data stored for an extended period on a computer, mobile phone, or other device) to make the Services easier to use and to protect both you and All Around Music. These cookies give All Around Music Information about your use of the Services. As part of registering as a User, All Around Music requires you to input a Username, password, and a valid email address. All Around Music stores and compiles this data and may retain it from Users who have terminated their accounts for legal compliance purposes or to maintain the ongoing confidentiality, integrity, availability, and resilience of All Around Music's systems, Website, and Service.
When you access the Services from a computer, mobile phone, or other device, we may collect Information from that device about your browser type, location, and IP address, as well as the pages you visit.
This information is provided through All Around Music’s use of Google Analytics and Facebook Pixel.
As part of the Service, All Around Music also records all teaching lessons, including video, audio, and chat features of both Instructors and Users. These recordings are used solely for the purpose of ensuring quality and legal compliance and will never be shared with third parties unless required by law.

All Around Music does not collect Sensitive Personal Information. While All Around Music does not collect this Information, we recognize that you may store some Information of this kind in your account. If you choose to keep Sensitive Personal Information in your account or private storage, you are responsible for complying with any regulatory controls regarding that data.

Section 4: How All Around Music Uses Collected Information
All Around Music uses Information provided to operate the Service and to contact you regarding changes, updates, account Services, customer Service, or any other reason associated with the Service or your use of the Service.
All Around Music may contact you with Service-related announcements from time to time. These include necessary Software updates and Web Portal or Website outages, among other things. All Around Music requires an email address to become a User to allow All Around Music to make these communications. You may opt out of all communications except essential updates.
All Around Music may also contact you with direct advertisements related to your use of the Services. These can include potential upgrades, Service options, or manufacturer model offerings, among others. The purpose of these communications is to inform you about new Services or features available for purchase from All Around Music. You can opt out of receiving advertisements from All Around Music.

All Around Music adheres to the General Data Protection Regulation (“GDPR”) and the California Consumer Privacy Act (“CCPA”) with respect to all Personal Information. The following are the provisions of the GDPR and CCPA with regard to this policy.

To the extent necessary for those purposes, All Around Music shall take reasonable steps to ensure that Personal Information is accurate, complete, current, and reliable for its intended use.

Access: All Around Music will allow you access to your Personal Information and allow you to correct, amend, or delete inaccurate Information. Access will not be allowed where the burden or expense of providing access would be disproportionate to the risks to your privacy or where personal rights other than your own would be violated. Access will only be granted a maximum of two times during any twelve-month period. While accessing your Information, you will be allowed to export a copy of your Information.

Enforcement: All Around Music uses a self-assessment approach to assure compliance with this Policy and at least annually verifies that the Policy is accurate, comprehensive, prominently displayed, completely implemented, and accessible to remain in conformity with the GDPR and the CCPA.

Dispute Resolution: All Around Music encourages you to raise any concerns using the contact Information we provided. We will investigate and attempt to resolve any complaints and disputes regarding the use and disclosure of Personal Information in accordance with the GDPR and the CCPA. If a complaint or dispute cannot be resolved through our internal process, we agree to dispute resolution using the small claims courts of Wisconsin as a third-party resolution provider.

Section 6: How All Around Music Treats Information from Children Under 13 Years Old
All Around Music is a website that provides online music lessons using video conference technology. We welcome students of all ages and as such are compliant with the Children’s Online Privacy Protection Act of 1998 (“COPPA”). We, therefore, take special precautions when collecting personal information from children under the age of 13.

COPPA requires we inform parents and legal guardians about how All Around Music collects, uses, and discloses personal information from children under the age of 13 years. Furthermore, COPPA requires we gain consent from parents and/or legal guardians in order for children under the age of 13 years to use certain features of our website.

What information is collected from children?
We do not collect personal information from children unless they register on the All Around Music website. The only personal information that is collected during the registration process is the parent’s email address, the student's and parent’s name, booking information, and any recordings made by All Around Music in providing the Service.

Any and all recordings made by All Around Music will be used solely for the purpose of ensuring quality and legal compliance, and will never be shared with third parties unless required by law. These recordings will be considered confidential and will be treated as such by All Around Music.

All Around Music requires a registering user’s age prior to registration. If the user is under the age of 18, he or she is prompted to provide a parent or guardian’s contact information so that All Around Music can communicate with the parent or guardian regarding the account.

All Around Music does not share user information with third parties, unless stated otherwise or under special circumstances.

How is the information collected used?
All Around Music uses the information collected during the registration process to communicate with users and provide services- the information collected is never sold to unaffiliated third parties.

By using All Around Music services, you may be granting access to personal information to third parties including Google. All Around Music uses Zoom to provide class services, therefore you may be granting Zoom additional rights to the live content that is streamed during the lesson. By purchasing and allowing your child to participate in online lessons, you are consenting to potential third-party information exchange. Use of Zoom is governed by its own Terms and Privacy Policy.

How do we notify and obtain consent from parents regarding their children’s information?
If your child under the age of 18 years attempts to register with the All Around Music website, he or she will be prompted to provide his/her parent or guardian’s contact information. By purchasing classes for your child under the age or 18, parents and guardians are consenting to the collection of their child’s information.

What access and rights to parents have?
Parents and guardians have the right to review the information that has been collected from their child. Parents and guardians additionally have the right to withdraw consent of the use or collection of personal information from their child and may request their child’s information be deleted from the All Around Music system.

Section 7: How All Around Music Secures Your Information

Section 8: How All Around Music Responds to Compelled Disclosure
All Around Music will not sell or otherwise transfer your private Information except where essential for providing the Services. However, All Around Music will give out Personal Information to comply with applicable law or a court order, to prevent harm or injury, or to prevent fraud or other illegal activity. All Around Music may be required to share Information with government entities from a foreign country. You cannot opt out of this provision or otherwise force All Around Music to hold Information confidential in such a way as to cause All Around Music to violate any law.
